A lawsuit against a hostel filed by a man alleging he was denied a job there because he complained that free room and board were not legal compensation for work has been dismissed.

U.S. District Judge Timothy J. Savage of the Eastern District of Pennsylvania denied pro se plaintiff Gordon Roy Parker's motion for reconsideration of a prior dismissal of his case against City House Hostels.

While Parker claimed the compensation arrangement for the resident assistant position violated the Fair Labor Standards Act and that he was denied employment for pointing that out, Savage said in his opinion that the plaintiff didn't have standing to file suit: “Prospective employees, such as Parker, cannot bring a retaliation claim against prospective employers under the FLSA.”
