An Allentown lawyer has been suspended from practicing law after pleading guilty to failing to pay withheld payroll taxes to the Internal Revenue Service.
Douglas Marinos has been suspended on consent, effective May 3, the Pennsylvania Disciplinary Board announced Tuesday. In January, Marinos pleaded guilty to one felony count of willfully failing to collect, truthfully account for and pay taxes owed by his law firm.
Marinos allegedly withheld payroll taxes at his law firm but failed to pay those taxes to the IRS.
The Allentown law firm operated at different times as Douglas M. Marinos P.C., CPMMD PC and The Law of Business, according to a federal information. Marinos was the sole owner of the firm and the only person with control of its finances, the information said.
Prosecutors in the U.S. Attorney's Office for the Eastern District of Pennsylvania said Marinos failed to file Form 941 returns from 2011 through 2015. He withheld payroll taxes, including Social Security and Medicare contributions, from his employees but did not pay them to the IRS, the U.S. Attorney's Office said.
Federal filings did not make clear how many employees Marinos had at the firm. Testimonials on the firm's website suggest he had at least two. According to that website, the firm provided business and commercial law, real estate, debt collection, bankruptcy, estate planning and personal injury services.
Marinos is scheduled to be sentenced May 24. According to the U.S. Attorney's Office, he faces up to five years in prison, three years of supervised release, a $10,000 fine, and a $100 special assessment. He has also been ordered to pay $285,000 in restitution to the IRS.
Scott Godshall, who is representing Marinos in the criminal case, did not immediately respond to a call seeking comment Tuesday afternoon.
