A CSX railway employee who thought his co-workers were insulting him, and who took matters into his own hands, has lost his discrimination lawsuit against the company.

U.S. District Judge Mark Kearney of the Eastern District of Pennsylvania granted CSX’s motion to dismiss plaintiff John Fleet’s complaint. Fleet, who was terminated on grounds of insubordination, claimed he was fired because he is black and has diabetes.
