The Commonwealth Court en banc has ruled in a matter of first impression that, in cases where an employer pays an employee the full wages on the date he or she become disabled, the employee does not become eligible for workers’ compensation benefits until the following workday—and that day begins the 90-day notice of temporary compensation payable (NTCP) period.

In Valley Stairs and Rails v. Workers’ Compensation Appeal Board (Parsons), the court reversed an order of the Workers’ Compensation Appeal Board that found claimant Gary Parsons’ disability began on the actual date of his injury.
