A saxophone player whose music went viral in a 2014 YouTube video has sued Epic Games Inc. over claims that the company is using his “signature” dance moves in the “Fortnite Battle Royale” video game.

The lawsuit, Pellegrino v. Epic Games, was filed April 25 in the U.S. District Court for the Eastern District of Pennsylvania by musician Leo Pellegrino, a Pittsburgh native, who plays baritone sax in the group Too Many Zooz. Since becoming a hit on YouTube, the group has been featured on several TV commercials and has worked with renowned recording artists like Beyonce.

The lawsuit, filed by Andrew Lorin of Pierce Bainbridge Beck Price & Hecht, in New York, is the latest in a series of lawsuits the firm has lodged against Epic regarding allegedly stolen dance moves being used in “Fortnite.” One of those lawsuits was filed by actor Alfonso Ribeiro over his “Carlton Dance,” which was made famous on the TV show “Fresh Prince of Bel-Air.” Those claims, which were based on copyright infringement, were later dropped.
