On June 16, 2012, plaintiff Tristan Gatineau, 28, an auto mechanic, was stopped in traffic while driving west on Black Horse Pike, in Hamilton Township, New Jersey. His sport utility vehicle was rear-ended by a car. The impact pushed his vehicle into the back of the one stopped in front of him. Gatineau claimed neck and back injuries.

Gatineau sued the driver, Alan Rosenbaum, alleging that he was negligent in the operation of a vehicle. Rosenbaum stipulated to liability, and the case was tried on the issues of causation.
