The Pennsylvania Supreme Court has partially reversed a Commonwealth Court ruling in favor of General Motors in a case that raised two first-impression issues involving dealer reimbursement for auto repairs under warranty.

A three-judge panel of the Commonwealth Court ruled 2-1 in 2017 that, with regard to reimbursements, GM was within its rights to enforce contractual terms that are not specifically authorized by Pennsylvania’s Board of Vehicles Act. That ruling reversed a final order of the State Board of Vehicle Manufacturers, Dealers and Salespersons.
