The Pennsylvania Supreme Court has granted an appeal in a high-profile murder case to decide whether to retroactively apply its landmark 2017 decision raising the prosecutorial burden for seeking life without parole for juvenile offenders.
On July 24, the justices granted allocatur in Commonwealth v. Stahley, agreeing to review a precedential December 2018 ruling in which a divided three-judge Superior Court panel upheld a Montgomery County trial court’s dismissal of defendant Tristan Stahley’s Post-Conviction Relief Act petition.
