The Pennsylvania Superior Court has ruled that an Allegheny County court wrongly dismissed a motorist’s bad-faith claim against State Farm Insurance under the doctrine of res judicata because the cause of action differed from that of a similar lawsuit that was previously tossed.

A three-judge panel consisting of Superior Court Judges Mary Jane Bowes, Carolyn Nichols and John Musmanno granted plaintiff William Simmons’ request to reverse the dismissal of the case and remand for new proceedings.
