Stradley Ronon Stevens & Young's Samuel J. Arena Jr. served as a moderator at the American Bar Association insurance coverage litigation committee midyear conference in Phoenix.
Arena moderated the session, "An Insurer's Settlement Duties and Bad Faith Liability Under the ALI Restatement of the Law, Liability insurance: What is New and What you Need to Know."
The session brought together counsel representing the insurer perspective (Martin P. Lavelle of the Travelers Insurance Cos. and Rachael Padgett of Crowell & Moring), the policyholder perspective (Rachel Kronowitz of Gilbert) and the academic perspective (Chaim Saiman of Villanova University Charles Widger School of Law).
Panelists discussed the restatement's novel approach to the insurer's obligations in the third-party liability claim settlement and non-settlement contexts, remedies for breaches of those obligations, and the implications of the restatement's approach for coverage litigation and claims handling.
Arena began concentrating his practice on insurance law, and fidelity and surety law more than 36 years ago.
A leader in Stradley Ronon's insurance practice group and the chair of the firm's fidelity and surety practice group, he represents insurance companies in complex insurance coverage and fidelity and surety matters.
Arena has experience representing insurance companies in bad-faith and extra-contractual liability claims and litigation.
He is a fellow of the American College of Coverage Counsel and an adjunct professor at Villanova University Charles Widger School of Law, where he teaches advanced insurance law coverage disputes.
