A Germany-based chain manufacturer has lost its appeal to open a default judgment entered against it in an injury lawsuit, with the Pennsylvania Superior Court affirming a ruling that the company failed to act in time.

A three-judge panel consisting of Judges John Bender, Anne Lazarus and Eugene Strassburger III upheld a Philadelphia judge’s denial of defendant KWS Inc.’s request to open the default judgement entered against it in plaintiff Eric Scalla’s lawsuit.
