"Examining the unambiguous statutory language in conjunction with the household vehicle exclusion," Lancaster County Court of Common Pleas President Judge David Ashworth wrote, "the court finds that such policies operate to 'strip an insured of default UM/UIM coverage without requiring an insurer to demonstrate, at a bare minimum, that the insured was even aware that the exclusion was part of the policy.'"

A Lancaster County judge has denied an insurance company's request for a declaration that its household exclusion policy means it does not have to pay UIM benefits to the family of a man injured in a motorcycle accident.
Lancaster County Court of Common Pleas President Judge David Ashworth's ruling in Donegal Mutual Insurance Co.'s case against the Krautsack family comes after the state Supreme Court's landmark ruling in Gallagher v. Geico.
