A divided federal appeals court has overturned a ruling allowing the recording of bail hearings in arraignment court in the Philadelphia criminal justice system, dealing a blow to First Amendment advocates.

The U.S. Court of Appeals for the Third Circuit ruled 2-1 to reinstate the recording ban, opposed by the plaintiffs, the Philadelphia Bail Fund, a criminal justice reform organization that sued the city’s bail magistrates over the policy.
