The Superior Court of Pennsylvania has upheld a trial court’s dismissal of a complaint alleging damages from toxic chemicals used in an Armstrong World Industries flooring plant in Lancaster.

Lancaster County Court of Common Pleas Judge Leonard Brown III dismissed the complaint based upon the preliminary objections filed by the defendants, Senior Judge John Musmanno said in a memorandum joined by President Judge Jack Panella and Judge Victor Stabile. The panel affirmed that decision, finding that many of the plaintiff’s arguments were waived.
