The Pennsylvania Supreme Court has agreed to review an election case where a Commonwealth Court judge decided that observers may come within six feet of those canvassing ballots in Philadelphia.

The justices decided on a 5-2 vote to review the matter. The Commonwealth Court decision rejected a trial judge’s decision that 15 feet was close enough. Commonwealth Court Judge Christine Fizzano Cannon on Nov. 4 agreed with lawyers for the GOP who said their poll watchers did not have sufficient access to canvassing.
