The year 2020 has proven to be unpredictable for everyone, including Philadelphia employers. In addition to the significant impact of the global pandemic on all employers, several state and local workplace laws have further altered the legal landscape for local employers. Philadelphia employers can expect more of the same in 2021. As 2020 approaches its end, here is a quick recap of five critical workplace law changes experienced by Philadelphia employers this year:

Philadelphia’s Salary History Ban. Philadelphia’s Wage Equity Ordinance has survived more than three years of litigation and, as of Sept. 1, is officially, in effect. Philadelphia businesses now are prohibited from:

  • Inquiring about a job applicant’s wage history;
  • Requiring an applicant to disclose their wage history;
  • Conditioning employment or interviews on the disclosure of wage history;
  • Retaliating against an applicant for not responding to a wage history inquiry; and
  • Using an applicant’s wage history to determine their wages unless the applicant “knowingly and willingly” disclosed their wage history.
