A federal judge in Pennsylvania has ruled that a woman who was injured during a bus tour in New Zealand can sue travel website Tripadvisor for its role in helping her book the excursion where she was hurt.

U.S. District Judge Gerald Pappert of the Eastern District of Pennsylvania denied defendant Tripadvisor's motion for dismissal of plaintiff Kristie Putt's negligence, misrepresentation, and negligent infliction of emotional distress claims.

According to Pappert's opinion, Putt booked the bus tour through the Tripadvisor-owned website Viator as part of her family's New Zealand vacation in 2017. She alleged that the seat belts on the bus had been removed by the driver. At one point during the tour, the bus hit a large ditch causing Putt to fly three feet out of her seat and smash her head against the bus roof, which her sons witnessed.
