The Pennsylvania Superior Court has upheld a Philadelphia judge’s overturning of a $3 million verdict against a Berks County children’s residential facility and a ruling that the plaintiff’s attorney engaged in misconduct.

In a March 26 memorandum opinion, a three-judge panel consisting of Judges Megan McCarthy King, Victor Stabile and Dan Pellegrini upheld Philadelphia Court of Common Pleas Judge Sean F. Kennedy’s grant of defendant Bethany Children’s Home’s motion for judgment notwithstanding the April 2019 jury verdict.
