Two bills pending before the Pennsylvania House of Representatives during the 2020-2021 session could have far-reaching implications for the construction industry within the commonwealth. The first of these bills, HB401, would amend the Construction Workplace Misclassification Act. The prime sponsor of this bill is Rep. John Galloway of Bucks County.

The classification of individuals as employees versus independent contractors has become a hot-button topic across numerous industries. Perhaps most visible are the continued legal battles between ride-hailing companies, the drivers of those companies, and government entities with respect to the appropriate classification of the drivers as either employees or independent contractors. From California to London, ride-hailing companies have fought to continue to classify the drivers as independent contractors, thereby limiting their obligations regarding pay and benefits.
