In abandoning its appeal on the issue, First Judicial District arraignment courts must now allow journalists and observers to record bail proceedings in Philadelphia as previously ordered by a federal court.

Prior to the Philadelphia arraignment court magistrates dismissing their appeal, the U.S. Court of Appeals for the Third Circuit agreed to hear reargument in the case at the request of the Philadelphia Bail Fund. The circuit court originally upheld Philadelphia’s policy of denying audio recording during bail hearings.
