In determining that state law is unresolved on two issues of medical device products liability, the U.S. Court of Appeals for the Third Circuit has sent the issue to the Pennsylvania Supreme Court for review.
In a petition for certification authored by Judge Cheryl Ann Krause, a three-judge Third Circuit panel put forth two questions stemming from the case Ebert v. C.R. Bard.
