The Pennsylvania Supreme Court agreed Monday to hear arguments over whether a doctor’s testimony about blood alcohol level and its effect on memory and perception constitutes impermissible expert testimony about a witness’ credibility.

The justices agreed to review the Superior Court’s ruling, which found the trial court properly granted the commonwealth’s motion in limine to preclude the admission of expert testimony relating to the off-duty officer’s level of intoxication during an altercation with defendant Dante Brown in a fast food drive-thru.
