A federal judge has knocked off two claims from an antitrust complaint filed by TV personality Suzanne Somers and her company against QVC in which she alleged the network edged her out of the nutritional supplement market.

U.S. District Judge Chad Kenney of the Eastern District of Pennsylvania granted QVC's motion for partial summary judgment on counts five and nine of the 13-count complaint, which deal with a violation of the California Business and Professions Code and a Sherman Act violation, respectively.

Somers and her company, SLC Sweet Inc., alleged QVC "acted to monopolize the television programming nutritional supplement market and engaged in anticompetitive, exclusionary, and predatory conduct," according to Kenney's opinion. Additionally, Somers alleged the network breached a merchandising agreement it had with her.
