The Pennsylvania Superior Court helped clarify what warrants a deviation from the child support guidelines in the recent matter of Thompson v. Thompson, 2021.

The case in Thompson involved a mother and a father who essentially shared physical and legal custody of three children. Eventually, due to the mother’s concerning behavior, which included an automobile accident due to driving while intoxicated with one of the children in the car, the father petitioned for, and was granted, greater custody of the children. Indeed, the mother’s custody was suspended for a time in light of her recent behaviors.
