A civil suit that scrutinizes an employer’s role as an “enabler” in a sexual assault will move forward against not only the doctor who perpetrated the alleged assault, but also the doctor’s corporate employer.

Lackawanna County Court of Common Pleas Judge Terrence Nealon has ordered the case, J.C. v. Horizon Medical, which involves an allergist who allegedly lured a former medical student into his office and then sexually assaulted her, to proceed to trial. The suit raises claims against the doctor, Joel Laury, as well as his employer, Horizon Medical Corp. Nealon’s Oct. 8 decision overruled the defendants’ preliminary objections.
