In a blow to auto insurance companies doing business in Pennsylvania, the state Superior Court has upheld a ruling invalidating the “regular use” exclusion to uninsured/underinsured coverage.

A three-judge panel consisting of Judges Alice Dubow, John Bender and Correale Stevens affirmed the Northampton County Court of Common Pleas’ ruling in Rush v. Erie Insurance Exchange that the exclusions went against the state’s Motor Vehicle Financial Responsibility Law.
