Noting that its sister circuits are divided on the issue, the U.S. Court of Appeals for the Third Circuit set precedent in a decision clarifying the ability of the government to decline intervention and dismiss private False Claims Act cases.

A three-judge panel consisting of Judges Cheryl Ann Krause, Kent Jordan and Luis Restrepo affirmed a lower court’s decision allowing the U.S. government to decline intervention and seek dismissal of plaintiff Dr. Jesse Polansky’s and several states’ qui tam suit against defendant Executive Health Resources.
