The Pennsylvania Superior Court has struck down a trial court’s decision that would have given the defendants in a personal injury case unmitigated access to the plaintiffs’ mental health records. 

The appeals process for the Philadelphia Court of Common Pleas order compelling the plaintiffs to produce the records delayed the case by two years. In the end, the Superior Court’s decision fell in line with rules that, according to the plaintiffs’ attorney, Keith West, were already well-established.
