A personal injury attorney who also serves as council president for a Northeastern Pennsylvania borough cannot escape being deposed in a lawsuit brought by a borough employee, who is also a client of the council president’s law firm.

Late last month, Lackawanna County Court of Common Pleas Judge Terrence Nealon ruled that Michael Dempsey of Lenahan & Dempsey must sit for a limited deposition in the products liability lawsuit Butler v. Scranton Manufacturing. Along with being an attorney at the Scranton-based law firm, Dempsey is also council president for the borough of Dunmore.
