A negligence suit against the School District of Philadelphia over a sexual assault is bound for trial after the defendants failed to convince a judge that the scope of a sovereign immunity exception should be immediately examined in appeals court. 

In an opinion denying the defendant’s motion to certify a past order for interlocutory appeal, Judge Vincent Johnson of the Philadelphia Court of Common Pleas shut down the school district’s argument that the application of an exception to the Political Subdivision Tort Claims Act was open to interpretation.
