A federal judge has for the second time determined that Pennsylvania’s new disciplinary rule aimed at curbing biased and discriminatory speech by attorneys is an unconstitutional infringement on the First Amendment.

U.S. District Judge Chad Kenney of the Eastern District of Pennsylvania ruled Thursday that Rule 8.4(g), which the state Supreme Court adopted last year, was not narrowly tailored enough to survive strict scrutiny, and was unconstitutionally vague.
