The Commonwealth Court overruled the secretary of the commonwealth’s preliminary objections to a lawsuit challenging the office’s directive that prohibited all county boards of election from using third-party consultants to inspect electronic voting devices.

The Fulton County Board of Elections and its County Commissioners Stuart L. Ulsh and Randy Bunch filed an amended petition for review with five counts to challenge the secretary’s “decertification” of two electronic voting devices in August 2021.
