Health care giant University of Pittsburgh Medical Center can be held liable as a state actor for its alleged policy of relaying the unconfirmed drug test results of new mothers to state child service agencies for further investigation, a federal judge has ruled.

The decision in Harrington v. UPMC, which U.S. District Judge W. Scott Hardy of the Western District of Pennsylvania issued May 20, rejected arguments that the health care provider should not be held liable for constitutional claims stemming from alleged violations of its patients’ privacy, due process and 14th Amendment rights.
