A federal judge in Pennsylvania has certified a class for purposes of settling a Title III claim under the Americans with Disabilities Act against an online retailer that failed to provide accessibility to the visually impaired.

According to U.S. District Judge Richard Lanzillo’s June 10 opinion, Anthony Hammond Murphy alleged that The Hundreds is Huge, an online clothing store, failed to provide full accessibility to blind or visually impaired individuals in violation of “the effective communications and equal access requirements of Title III of the ADA.” Murphy asserted the claims in the U.S. District Court for the Western District of Pennsylvania, on behalf of himself and those similarly situated who have accessed or attempted to access the website. The Hundreds consented to the relief proposed in the motion.
