A federal judge declined to award attorney fees to a defendant in a trade secrets case despite a jury finding that the plaintiff had acted in bad faith by bringing the suit.

Judge Stephanos Bibas of the U.S. Court of Appeals for the Third Circuit asked the jurors to consider in a special verdict whether the plaintiffs acted in bad faith, but he ultimately rejected the notion that the plaintiffs brought their claim without evidence.
