The Pennsylvania Superior Court on Tuesday affirmed a trial court ruling that a nursing home’s arbitration agreement was unconscionable and could not be enforced in a wrongful death suit filed by the daughter of a deceased resident.

The decision breaks from a pattern of recent case law favoring defendants in challenges to arbitration agreements, said Kristin Hoffman of Wilkes & Associates, who represented the plaintiff.
