A lawyer’s argument that an appeals court improperly made findings of fact was not enough to penetrate the immunity doctrine protecting three Superior Court judges from his suit over a judicial opinion.

The Commonwealth Court’s Tuesday decision upholding the dismissal of Bruce Chasan’s suit against the judges found the protections still applied, rejecting for the second time Chasan’s theory that the defendants opened themselves to liability by exceeding their jurisdiction.
