A Pennsylvania appeals court removed a stay of arbitration on a derivative action a man brought on behalf of his partnership against the advice of special litigation committee.
The Superior Court found that James Miller's claims fell within the scope of his partnership agreement's arbitration clause, reversing a trial court's decision saying a court must determine whether the SLC's finding barred his derivative action.
