A private prison's report on an inmate's suicide is not subject to peer review privilege, the Pennsylvania Superior Court has ruled, upholding a granted discovery motion in a negligence action over the inmate's death.
Kline & Specter's Charles Becker, who represents the decedent's mother, said the court's Wednesday opinion draws a distinction under the Peer Review Protection Act between documents created through peer review and those created as routine policy.
