Plaintiffs and defendants in Philadelphia’s products liability mass tort for the herbicide paraquat are at odds over exactly how consolidated the consolidated proceedings should be.

In dueling case-management order proposals, defendants argued that their approach avoided violations of their due process rights while plaintiffs say the defense’s suggestions would defeat the point of consolidation.
