What is one area where you see many lawyers not properly following the Rules of Professional Conduct, or misunderstanding a particular section?

One of the areas that this writer has seen a lot of confusion in involves having a professional liability insurance policy. There has been confusion and still is among lawyers as to whether or not they are required to have a professional liability policy. There should be no confusion in that area because the law is very clear as are the Rules of Professional Conduct that a lawyer does not have to have professional liability insurance. Failure to require professional liability insurance is somewhat surprising. A professional such as doctors are required to have professional liability insurance. In fact, a doctor is usually strongly disciplined if they let their policy lapse even if it is through inadvertence.
