In an attempt to clarify previous conflicting rulings, the U.S. Court of Appeals for the Third Circuit vacated a lower court’s criminal sentencing in which the career offender enhancement was applied based on a conviction for conspiracy.

The appeals court reached that conclusion based on a finding that the precedent established by the U.S. Supreme Court ruling in United States v. Preston has since been overruled.
