A Pennsylvania county's novel approach to holding paint manufacturers liable for residential lead contamination failed to pass muster before the Commonwealth Court.
A unanimous en banc panel on May 5 rejected Montgomery County's argument that lead paint constitutes a public nuisance, shutting down an avenue for a political subdivision to combat exposure risks.
