A federal judge has rejected a confectionary’s motion to dismiss claims brought by a man who was trapped for hours in a hardened chocolate substance while cleaning a micron tank at the company’s facility.

In a May 17 opinion, U.S. District Judge John M. Gallagher of the Eastern District of Pennsylvania denied Mars Wrigley Confectionery’s motion to dismiss claims of false imprisonment, infliction of emotional distress, recklessness, and punitive damages brought by Louis Torres Crespo, who had been trapped in a chocolate tank for six hours, after determining the claims were sufficiently pleaded.
