A federal judge in Pennsylvania determined freight transportation company Estes Express Lines was excluded from receiving damages after it failed to produce an expert opinion requesting nearly $11 million before the discovery deadline, which had already been extended multiple times.

U.S. District Judge William S. Stickman IV of the Western District of Pennsylvania granted U.S.A. Lamp and Ballast Recycling Inc. d/b/a Cleanlites Recycling Inc.’s motion to preclude Estes Express Lines’ damages claims not disclosed in discovery, after determining that Estes had failed to comply with its disclosure obligations and the exclusion of damages was warranted.
