For the firm's work defending top law firms and high-profile attorneys, handling the U.S. Court of Appeals for the Third Circuit's first hybrid trial, and setting precedent regarding legal malpractice in Pennsylvania suits along the way.

There has been some speculation that, as a result of the stressors from the COVID-19 pandemic, we would see an increase in professional liability litigation. Has that proven true?

Not yet. Many cases are still working their way through the case backlog and subsequent appeal process. Courts were also generous with additional time and very forgiving about issues, like missed deadlines, etc., that arose due to the pandemic. Many cases settled because of the long delays (that could increase the recoverable damage), which is a bar to a legal malpractice action. There seems to be an uptick of sanctions-related issues for misconduct, in particular in Zoom-related proceedings. 2022 was extremely challenging from a workload perspective. Trials were scheduled back-to-back or double or triple booked, hiring was (and remains) difficult and litigation vendors and experts were understaffed and scheduled to capacity. The post-pandemic "catch up" activity that overwhelmed many lawyers is likely to be a source of claims.
