In two separate opinions, a federal judge in Pennsylvania allowed suits against Delta Air Lines and JetBlue Airways to move forward on claims for violation of the Pennsylvania Wiretap Act, over allegations that the airlines’ websites track and record users’ computer movements and personal information without consent.

U.S. District Judge Robert J. Colville of the Western District of Pennsylvania partially denied JetBlue and Delta’s motions to dismiss June 3 as to plaintiffs’ wiretap claims, concluding the airlines’ websites utilized Session Replay Code, a device that intercepts under the meaning of the Pennsylvania Wiretap Act.
