The Pennsylvania Superior Court on Monday threw out an $8.3 million attorney fee judgment awarded to a chemical manufacturer in a lawsuit over chlorine gas damage to its plant.
The three-judge panel ruled that the trial court wrongly interpreted an agreement between the parties as allowing the plaintiff to recover attorney fees from the defendant arising from claims it pursued against them.
