A federal judge in Pennsylvania determined that some of an independent contractor’s counterclaims against a real estate services company can proceed to trial, determining a jury waiver provision in the parties’ business agreement doesn’t clearly apply to all of the claims.

In a Monday opinion, U.S. District Judge John F. Murphy of the Eastern District of Pennsylvania concluded that Paige Jaffe, a former business associate of Jones Lang LaSalle Americas (JLL), a commercial real estate company, can proceed with her counterclaims of discrimination and trade secret and unfair competition. The court concluded the agreement at issue did not include a jury waiver for those claims under provisions of the parties’ independent contractor agreement.
