Former Schnader Harrison Segal & Lewis income partner Jo Bennett’s suit against her now-shuttered firm for allegedly misappropriating salaried senior attorneys’ compensation since 2018 will advance, after a Pennsylvania federal judge rejected a motion to dismiss Monday.

Bennett, now stationed as a partner and labor and employment chair at Culhane Meadows, filed her class action suit against Schnader and 34 of its equity partners in February, claiming that the firm violated Employee Retirement Income Security Act requirements and required eligible nonequity partners and counsel to defer a portion of their annual compensation into the firm’s pension plan despite the pension plan not requiring such contributions.
